The Tenantries Freehold Purchase Act was enacted in November 1980 with the intention of creating tenantries within the island and providing qualified tenants of lots within these tenantries with the right to purchase their lots.
The first step for any tenant under the Tenantries Freehold Purchase Act is to complete a Form I Notice and forward the same to his/her landlord or the attorney acting on behalf of the landlord. After forwarding the Form I Notice to the landlord, two copies should be deposited with the Minister responsible for Lands.
The Act gives the Land Registry the authority to act in place of the landlord in certain circumstances, namely where the landlord has refused to convey the parcel, has not appointed an attorney, cannot be located or his/her identity cannot be ascertained.
Where the tenant requires the Land Registry’s action, he or she is required to complete a Form II Notice and deliver it to the Tenantries section of the Land Registry together with a copy of the Form I Notice which has been signed and stamped on behalf of the Minister responsible for Lands.
On receipt of the Form I and II Notices, the Land Registry is required to conduct the following activities:
