All parcels not declared as registered under the Land Registration Act, Chapter 229 of the Laws of Barbados must be dealt with under the common law system of titling. 

Under the Property Act, Chapter 236 of the Laws of Barbados, all documents prepared under the common law of land titling must be recorded at the Land Registry to give the public notice of all land transactions that have occurred.  The Land Registry is therefore responsible for receiving these documents, extracting information from each document for entry into a database and scanning a copy of the document into the database.

One of the primary responsibilities of the Land Registry is to safeguard this information to ensure that all persons conducting legal transactions affecting lands in Barbados, can do so with the assurance that any searches will reveal the true legal status of the parcel.

The Land Registry must therefore extract the relevant information for searches to be conducted, ensure the information is accurate and maintained in a format that is accessible and easy to understand by the public.

Additionally, the Land Registry is responsible for assessing all documents presented for recording to determine the duties, taxes and fees that are due to the Government of Barbados. The Registrar also has the responsibility of ensuring compliance with various statutory requirements in the instance of land transfers. These requirements include:

  • Notice to the taxing agency as to the change of ownership of a parcel (for land transfers and long term leases);
  • Notice to the taxing agency as to the payment of any commission to a real estate agent;
  • Verification that the parcel being transferred is not located within a special development area and therefore not subject to additional taxes; and
  • Confirmation that all land taxes due for the current financial year have been paid.
