Restoration

Under the Land (Title Deeds Restoration) Act, Chapter 229C of the Laws of Barbados (as amended by the Land (Title Proceedings) Act, 2011, the Registrar of Titles has the authority to restore common law documents as recorded under the Property Act in specific circumstances, namely where documents have been lost, stolen, misplaced or destroyed.

Therefore, in most circumstances, where a proprietor or interested party had possession of title deeds which cannot be used for one of the above reasons, an Application can be made to the Registrar of Titles for the restoration of the title deeds.

The Attorney filing for the restoration of title deeds must file an Application and an Affidavit in support of the Application. On filing the Application, the Attorney is responsible for advertising the Application in daily newspapers.  These advertisements must give the public the details of the Application being made and require any interested person who may have a reason that the document(s) should not be restored, to contact with Registrar within a specified time period.

Thereafter, the attorney is responsible for filing a Certificate of Restoration for signature by the Registrar of Titles. This Certificate should be recorded at the Land Registry after its execution and will be used in the future, instead of the missing title deeds. This restored document has the full legal effect of the original document.

Fees

There are no Application fees associated with an Application for the Restoration of Documents.

Recording fees of $4 per page must be paid for all documents filed.
